Brainwave Events terms and conditions All participants must read these terms and conditions prior to booking a place on a Brainwave event (hereinafter known as "The Event"). By booking onto The Event, you are confirming that you have read, understood and agree to the terms and conditions as set out below.* By booking a place at The Event, you hereby RELEASE, WAIVE, DISCHARGE, The Brainwave Centre Ltd, its employees, officers, sponsors, event organisers and volunteers from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained to your person, or to any property belonging, while taking part in the lead up to The Event, or, on the day of The Event. You must read and understand any risk assessments provided by Brainwave and any participating organisations for The Event. You must be fit to take part in The Event (as appropriate) and agree to inform Brainwave of any new medical conditions that may affect your ability to take part in The Event. If The Event is catered, and if you have any food allergies or intolerances, you must inform us at time of order, allowing us ample time to cater to your requirements as best we can. We CANNOT guarantee that any of our dishes are free from allergens and therefore cannot accept any liability in this respect. Guests with severe allergies are advised to assess their own level of risk and consume dishes at their own risk. Brainwave only has a limited number of places for The Event, and therefore no guarantees can be given that your application will be successful. We also reserve the right to refuse any application at our absolute discretion, without providing reasons for doing so. We will contact you in due course to confirm the status of your application. Brainwave reserves the right to cancel The Event or alter the date or time for any reason (including, but not limited to, occurrences of extreme weather). A full refund will only be offered if The Event is cancelled. In the case of The Event being postponed, attendees will be invited to carry their place over to the rescheduled date or receive a full refund. The exception being in the case of the Manchester Duck Race: if the event is postponed, we regret that we are unable to refund any payment made for ducks as attendance at the race is not required and will have no impact on the result of the races. Any tickets, registration fees and/or sponsorship are non-refundable in the event of your withdrawal from The Event. When taking part in The Event, we ask that you avoid behaving in any way which may cause offence or damage the reputation of Brainwave, for example by using aggressive or abusive language, or by behaving in a way which may cause injury or harm to other participants and/or spectators. This also includes refraining from smoking tobacco products or e-cigarettes during or around The Event. By taking part, all participants confirm that they are happy for any footage or photographs taken during their participation in The Event to be used to publicise Brainwave generally, including television, website, social media and DVD/video broadcasts. By taking part, all participants understand that Brainwave may distribute images of participants to those providing media coverage of the event and consent to their images being passed to them and being published in any media reporting details of The Event. These images can be used at any point in the future without limitation and without charge. By taking part, all participants understand that they will be sent communications regarding the administration of The Event. We recommend that children under the age of 15 do not take part in The Event (unless The Event's specific details stipulate that it is open to all age groups). All under 18 participants must be accompanied by a parent, guardian or responsible adult at all times. Auction, raffle and competition winners will be announced on the day of The Event and will be notified after The Event by telephone or email as appropriate. Details of winners of small lottery licenced raffles (including The Manchester Duck Race) will be added to our website as soon as possible after The Event has taken place. The judges' decision is final. All profits from The Event and any associated lotteries (unless otherwise specified) will be used to support the general charitable work of The Brainwave Centre Limited Registered Charity No. 1073238 (Scotland SC039137). *Please be aware that Brainwave undertakes a variety of events and that not all of the above will be relevant to the event you are attending. ADDITIONAL TERMS AND CONDITIONS FOR CLAY PIGEON SHOOTING EVENTS Firearms Under section 21 of the Firearms Act 1968 I declare that I am not a person prohibited by law from being in possession of a firearm by any of the following terms: A person who has been sentenced to preventive detention, or to corrective training for a term of three years or more, shall not at any time have a firearm or ammunition in his possession. A person who has been sentenced to corrective training for less than three years or to imprisonment for a term of three months or more, but less than three years, shall not at any time before the expiration of the period of five years from the date of his release, have a firearm or ammunition in his possession. A person who is subject to a recognisance to keep the peace or to be of good behaviour, a condition of which is that he shall not possess, use or carry a firearm; or subject to a probation order containing a requirement that he shall not possess, use or carry a firearm. It is an offence for anyone to contravene any of the aforementioned provisions of the Firearms Act 1968. I also declare that I have no medical condition or nervous disorder likely to cause a danger to myself or others whilst I am in possession of a firearm. ADDITIONAL TERMS AND CONDITIONS FOR THE MANCHESTER DUCK RACE On Good Friday a Race Control will be established in New Bailey between 0900 hours and 1700 hours. The Promoter is: Mr Phillip Edge, New Bailey Public Realm, New Bailey Street, Salford, M3 5AX On Good Friday, two Duck Races will be run, The Brainwave Original Duck Race and The Brainwave Corporate Duck Race; each race will be run as separate lotteries. The lotteries are authorised by Lottery Licence number 132100, issued by Salford City Council. Tickets can only be sold to persons 16 years of age and older. The lotteries are open to all Residents of the United Kingdom 16 years of age and over, except members of The Brainwave Centre Limited and their agencies directly involved in the running of the lotteries. All profits from the lotteries will be used to support the general charitable work of The Brainwave Centre Limited Registered Charity No. 1073238 (Scotland SC039137). Participation in the lotteries can be made by the purchase of a ticket (i.e.duck) either on the day from Race Control or online through the Brainwave website at www.brainwave.org.uk, where entries will be notified by email of their ticket numbers/names. Duck Race ticket numbers/names will be entered into the race only when the whole payment is received. The Brainwave Centre Limited accepts no responsibility for tickets which are lost, damaged, and illegible or from which the prize-winner cannot be identified, or for any technical failure or event which may cause the competition to be disrupted or corrupted. Any ticket entries received after the closing date may miss entry into the lotteries and therefore will be considered as a donation to the Brainwave Centre Limited. Winning ticket numbers/names will be the numbers/names corresponding to the first numbered/named ducks crossing the finishing line of the Duck Races held on Good Friday in New Bailey, as retrieved by event volunteers working at the finish line. If it is impractical to run the races, because of river conditions or any other reason, a member of the public will be asked to select, at random and in a public place, winning numbered/named ducks from all the ducks that were to participate in the races. Winning numbers/names will be announced after the race and displayed on the Brainwave website: www.brainwave.org.uk. To request a list of winners and numbers/names by post please send a stamped addressed envelope to: The Brainwave Centre Limited, Marsh Lane, Huntworth Gate, Bridgwater, Somerset TA6 6TN. The result of the race, as declared by the organisers, is final. No correspondence will be entered into. There are no alternatives to non-cash prizes, in whole or in part; non-cash prizes have no redeemable cash value and may be time limited. Winners contracts in respect of non-cash prizes are directly with the supplier of the prizes. The Brainwave Centre Limited shall not be liable for any loss or damage whatsoever suffered (including, but not limited to, direct, indirect, and/or consequential loss) or personal injury suffered or sustained in connection with the prizes or any part of them. There may be certain conditions attached to non-cash prizes. For example, age restrictions and or requirements for certain documentation. Players should keep their ticket or allocated number as proof of purchase and will be asked to produce their ticket(s) when claiming prizes. Where valid contact information is available, holders of winning tickets will be contacted by the organiser to arrange payment. Prizes may be collected on the day of the race, by contacting Race Control and supplying proof of purchase and identification, if required. Where the organiser is unable to contact a prize-winner so that a prize remains unclaimed for six months following the organiser’s first attempt to notify the prize-winner, the organiser may apply the prize as it sees fit, including re-offering the prize in future events. By claiming and accepting a prize players agree to publicity which will be carried out at the sole discretion of the Brainwave Centre Limited. All players are required to co-operate with the organiser’s right to publish their win, as and when deemed appropriate, and to provide proof of age when requested. In the event of an error, howsoever caused, whether a printing error or otherwise and whether obvious or otherwise, which affects the competition in any way, the organisers reserve the right to administer the lottery as though the error had not occurred. Where the organiser deems it appropriate and/or feasible the organiser will notify entrants of the error. Failure to comply with any of these rules may result in the disqualification of an entry in the lottery. The organiser reserves the right to disqualify any entry at their absolute discretion.
