Brainwave Charity Place Terms and Conditions All participants must read these Terms and Conditions before taking part in an third part event. By ordering through our website, you are confirming that you have read, understood and agreed to the Brainwave Charity Place Terms and Conditions. By applying for a Brainwave charity place at an event organised by a third party (an “Event”), you accept and agree to abide by the following terms: Brainwave only has a limited number of places for each Event, and therefore no guarantees can be given that your application will be successful. We also reserve the right to refuse any application at our absolute discretion, without providing reasons for doing so. We will contact you in due course to confirm the status of your application. If your application is successful we will ensure that your place is reserved for that Event, but you will still be required to register with the Event organiser to confirm your place. We will provide you with further information about this at a later stage. Please note that failure to register with the Event organiser may result in your place being lost, but you will not be entitled to a refund in these circumstances if you have paid a fee for your place. If your application is successful you will also be required to sign up to, and comply with, the Event organiser’s Event rules and/or terms and conditions. Please read these carefully, as they will set out the Event organiser’s obligations and liabilities to you and vice versa. Please note that Brainwave is not responsible for the organisation or management of the Event, and therefore we shall have no liability to you for any injury, damage or loss suffered by you when taking part in or in connection with the Event. If you are required to pay for a Brainwave charity place as part of the application process, we regret that we are unable to refund any payment unless your application is unsuccessful, or your application is successful but that Event is subsequently cancelled. If you choose to withdraw from the Event, the registration fee you have paid Brainwave is non-refundable. If you are granted a Brainwave charity place, please note this place is non-transferable. Any attempt to transfer your place may result in this place being lost, but you will not be entitled to a refund if you have paid a fee for your place. When taking part in an Event, we ask that you avoid behaving in any way which may cause offence or damage the reputation of Brainwave, for example by using aggressive or abusive language, or by behaving in a way which may cause injury or harm to other participants and/or spectators. This also includes refraining from smoking tobacco products or e-cigarettes during or around the Event. Each charity place at an Event represents an important and valuable source of fundraising for us. As we have made an investment to be able to offer places at Events, we therefore ask each applicant to pledge to raise a minimum level of sponsorship if they subsequently take part in an Event. We can of course provide help and advice with your fundraising activities if required. If you do not reach the minimum level of sponsorship, you will still be able to take part in the Event if you have completed your registration, but you may not be eligible for future Brainwave charity places, at the sole discretion of Brainwave’s Head of Fundraising. Please note that all monies that you do raise in connection with the Event are held on trust for Brainwave, and therefore you have a legal responsibility to ensure that all sponsorship monies/donations received in connection with an Event are paid to us. By taking part, all participants confirm that they are happy for any footage or photographs taken during their participation in the event to be used to publicise Brainwave generally, including television, website, social media and DVD/video broadcasts. By taking part, all participants understand that Brainwave may distribute images of participants to those providing media coverage of the event and consent to their images being passed to them and being published in any media reporting details of the event. These images can be used at any point in the future without limitation and without charge. By taking part, all participants understand that they will be sent communications regarding the administration of the event. Please check the specific Event details for minimum age requirements. We recommend that children under the age of 15 do not take part in these Events (unless the specific Event stipulates that it is open to all age groups). All under 18 participants must be accompanied by a parent, guardian or responsible adult at all times.
